This Privacy Policy explains how Clermont Endodontics collects, uses, stores and protects personal data when you visit our website, contact us, submit an enquiry or otherwise interact with us online.

We process personal data in accordance with applicable data protection law, including the General Data Protection Regulation (EU) 2016/679 (“GDPR”) and the Data Protection Act 2018, as applicable in Ireland.

Because we provide specialist dental and endodontic services, some of the information we process may constitute health data, which is a special category of personal data under the GDPR and is subject to additional protection.

5. Lawful bases for processing

Under the GDPR, we must have a lawful basis for processing personal data.

Depending on the circumstances, we may rely on one or more of the following lawful bases:

Performance of a contract

We may process your personal data where this is necessary to take steps at your request before entering into an agreement with you or to provide services to you.

Legal obligation

We may process personal data where necessary to comply with a legal or regulatory obligation.

Legitimate interests

We may process certain personal data where this is necessary for our legitimate interests, provided those interests are not overridden by your rights and interests.

Examples may include website security, administration, responding to general enquiries and protecting our business from fraud or misuse.

Consent

Where required, we may ask for your consent before processing personal data for a particular purpose.

Where we rely on consent, you may withdraw that consent at any time. Withdrawal of consent does not affect the lawfulness of processing carried out before consent was withdrawn.

Health information and special-category data

Health information is subject to additional protection under Article 9 of the GDPR.

Where we process health or other special-category information in connection with providing healthcare, we will do so only where an appropriate Article 9 condition and other applicable legal requirements are satisfied.

Where we request health information through an online form, we will seek to limit the information collected to what is reasonably necessary for the relevant purpose.

You should avoid submitting unnecessary sensitive medical information through a general website enquiry form.

6. Information submitted through our online forms

Our website uses Tally to provide online forms.

When you submit information through a Tally form, the information you provide is transmitted to Tally and made available to Clermont Endodontics so that we can respond to your enquiry or otherwise provide the relevant service.

Tally is a company based in Belgium, within the European Union. Tally states that form data is stored in Europe and is encrypted both in transit and at rest. Tally also provides a Data Processing Agreement for customers using its service.

For information submitted through our forms, Clermont Endodontics remains the data controller, while Tally acts as a data processor on our behalf in relation to the form submission service.

You can find further information about Tally's own privacy practices in its privacy notice.

7. Website hosting and Webflow

Our website is built and hosted using Webflow.

Webflow may process certain information relating to visitors and users of websites hosted on its platform. Webflow states that its services may involve processing or hosting personal data in the United States and other countries, and that it uses mechanisms including the EU–US Data Privacy Framework and contractual safeguards for applicable international transfers.

Where Webflow processes personal data on our behalf, we use it as a service provider/data processor in accordance with the applicable contractual and data-protection requirements.

You can review Webflow's current privacy information on its website.

8. Who may receive your personal data?

We may disclose personal data to appropriate third parties where necessary and lawful, including:

  • Website hosting and technology providers
  • Form providers, including Tally
  • IT and security service providers
  • Professional advisers
  • Payment and accounting providers
  • Healthcare professionals involved in your care, where appropriate
  • Referring dentists or other healthcare providers where appropriate and lawful
  • Regulatory authorities, government bodies or law-enforcement agencies where required
  • Other service providers acting on our behalf

We require processors handling personal data on our behalf to provide appropriate safeguards and to process personal data only in accordance with our instructions and applicable data protection law.

We do not sell your personal data.

9. International transfers

Some of our service providers may process personal data outside Ireland or the European Economic Area (“EEA”).

Where personal data is transferred outside the EEA, we will take appropriate steps to ensure that the transfer is carried out in accordance with applicable data protection law.

For example, Webflow states that it uses recognised safeguards for transfers of personal data from Europe, including the EU–US Data Privacy Framework and contractual safeguards.

The location and processing arrangements of third-party service providers may change over time. We will take reasonable steps to ensure that appropriate safeguards remain in place.

10. How long do we keep your information?

We retain personal data only for as long as is reasonably necessary for the purposes for which it was collected, unless a longer retention period is required or permitted by law.

Clinical and healthcare records may need to be retained for longer periods because of professional, legal, regulatory or insurance requirements.

The retention period for a particular type of information will depend on:

  • The purpose for which it was collected
  • Whether you are or have been a patient
  • Applicable healthcare and professional requirements
  • Legal or regulatory obligations
  • Our legitimate business requirements
  • Whether the information is required to establish, exercise or defend legal claims

Information submitted through a website enquiry form will generally be retained only for as long as reasonably necessary to deal with the enquiry and any resulting relationship, subject to any applicable legal requirements.

We will periodically review personal data and securely delete or anonymise information that is no longer required.

11. How do we protect your information?

We take appropriate technical and organisational measures designed to protect personal data against:

  • Unauthorised access
  • Accidental loss
  • Destruction
  • Alteration
  • Unauthorised disclosure
  • Other unlawful or unauthorised processing

No website, electronic communication or storage system can be guaranteed to be completely secure. However, we take reasonable steps to protect the information entrusted to us.

12. Cookies and similar technologies

Our website may use cookies and similar technologies.

Cookies may be used for purposes such as:

  • Essential website functionality
  • Website security
  • Understanding website usage
  • Performance and analytics
  • Remembering preferences

The specific cookies used by the website depend on the services and integrations currently enabled on the website.

Where consent is legally required for non-essential cookies or similar technologies, we will seek your consent before placing or using them.

You can manage cookies through your browser settings and, where applicable, our cookie consent mechanism.

13. Your data protection rights

Subject to certain legal conditions and exemptions, you may have rights under data protection law including:

  • The right to access your personal data
  • The right to have inaccurate personal data corrected
  • The right to request erasure of your personal data
  • The right to request restriction of processing
  • The right to object to certain processing
  • The right to data portability
  • The right to withdraw consent where processing is based on consent
  • Rights relating to automated decision-making and profiling, where applicable

These rights are not absolute and may be subject to legal or regulatory requirements.

For example, we may be required to retain certain healthcare or clinical records even if you request their deletion.

Our website may contain links to third-party websites, including websites operated by healthcare providers, professional organisations, social media platforms or other organisations.

We are not responsible for the privacy practices, content or security of third-party websites.

We recommend reviewing the privacy policy of any third-party website before providing personal information.

17. Children's privacy

Our website is not intended to knowingly collect personal information from children for purposes unrelated to providing healthcare.

Where we provide healthcare services to children or process information relating to a child in connection with healthcare, we will handle that information in accordance with applicable healthcare, confidentiality and data protection requirements.
